Summary: The IRS expects every US resident and citizen to file — even if income was earned abroad. This guide helps Kenyan professionals in America navigate the complexity of dual tax obligations, foreign income exclusions, FBAR requirements, and the most commonly missed deductions.

The Diaspora Tax Challenge

The Kenyan diaspora in the United States numbers over 150,000 people, remitting an estimated $1.5 billion annually to Kenya. Yet a large proportion of this community is over-taxed — either missing legal deductions or failing to claim foreign tax credits that could dramatically reduce their IRS liability.

As a dual-market firm serving clients in both the USA and Kenya, Kagiko & Associates frequently encounters Kenyan professionals who:

  • Don't know they must report Kenyan bank accounts above $10,000 (FBAR)
  • File as single when they qualify for Head of Household (larger deduction)
  • Miss the Foreign Earned Income Exclusion (up to $126,500 tax-free in 2024)
  • Fail to claim education credits, child tax credits, or healthcare deductions
  • Overlook depreciation deductions on investment property back in Kenya

W-2 vs 1099: Know Your Form

Your income form determines how you file. Many Kenyans working in the gig economy (Uber, delivery, freelancing, consulting) receive 1099s and are unaware they must pay self-employment tax (15.3%) in addition to income tax.

Tax withheld?✅ Yes — employer withholds❌ No — you pay quarterly
Self-employment tax?❌ Not applicable✅ 15.3% on net earnings
Business deductions?❌ Very limited✅ Phone, home office, mileage
Quarterly payments?❌ Not required✅ Required if owing >$1,000/year

Gig Workers Alert: If you earned more than $400 from any self-employment income in 2024, you are legally required to file a Schedule SE. Failure to do so is one of the most common triggers for IRS notices in the diaspora community.

Foreign Earned Income Exclusion (FEIE): Exclude Up to $126,500

Who Qualifies?

US citizens or Green Card holders who live and work in Kenya — or travel there for business for the majority of the year — may qualify for the Foreign Earned Income Exclusion (Form 2555) .

  • Bona Fide Residence Test

You were a bona fide resident of Kenya for an entire tax year.

  • Physical Presence Test

You were in Kenya for at least 330 full days during any 12-month period.

2025 FEIE Limit: $130,000 (indexed annually). This means if you earn $130,000 from Kenyan business activities, you could owe $0 in US federal income tax on that income.

FBAR & FATCA: Do You Have Kenyan Bank Accounts?

If you are a US person (citizen, Green Card holder, resident) and your foreign bank accounts had a combined balance exceeding $10,000 at any point during 2024, you must file an FBAR (FinCEN 114) by April 15, with an automatic extension to October 15.

FBAR Penalties Are Severe

  • • Non-wilful violation: Up to $10,000 per account per year
  • • Wilful violation: Up to $100,000 or 50% of account balance per year
  • • Criminal prosecution is possible for wilful non-disclosure

FATCA (Form 8938): If foreign financial assets exceed $50,000 (single filer) or $100,000 (married), file Form 8938 with your tax return. This is separate from FBAR and applies to a broader range of assets including pension accounts and equity in foreign businesses.
